General Terms and Conditions
Please read these Terms and Conditions carefully. By using the website silkwaytrips.com (hereafter the “Website”) and by submitting a booking and purchase of services (hereafter the “Booking”), you acknowledge and agree to be legally bound by these Terms and Conditions.
Silk Way Trips LLC is referred to as the “Company”. The person making the Booking is referred to as the “Client”.
The Company may amend these Terms at any time by posting an updated version on the Website. The revised terms take effect from the moment they are published.
1. General Provisions
1.1. These Terms govern the relationship between the Client and the Company regarding the use of the Website, the Booking, and the provision of travel-related services.
1.2. These Terms apply to all tours and services described in the itinerary, booking confirmation, invoice, or other official documentation provided to the Client.
1.3. The current version of the Terms is always available on the Website.
2. Governing Law and Dispute Resolution
2.1. The Client and the Company shall make all reasonable efforts to resolve any dispute amicably.
2.2. If resolution is not possible, the laws of the Kyrgyz Republic apply.
2.3. The Client irrevocably submits to the exclusive jurisdiction of the courts of the Kyrgyz Republic.
3. Bookings
3.1. A Booking is considered confirmed once the booking deposit is paid and Company issues written confirmation to the Client.
3.2. Any modification or cancellation of a Booking is subject to these Terms and the conditions stated in the invoice.
3.3. A compulsory Single Supplement may apply for Clients requesting single accommodation.
3.4. Some tours require specific equipment, clothing, physical fitness, or special permits. These requirements are described in the corresponding tour itinerary.
3.5. Individual tours may be arranged for any available dates upon agreement with a booking manager.
3.6. Group (fixed-date) tours require a minimum of 2 participants. If this minimum is not reached 30 days before the tour start date, the Company may cancel the tour, offer an alternative program, or refund the deposit paid by the Client.
4. Tour Price and Payment
4.1. Prices on the Website may differ due to seasonal changes, supplier pricing, transport costs, and other factors.
4.2. The final price of the Booking is determined individually and fixed only in the invoice issued to the Client.
4.3. The price in the invoice takes full priority over any Website information.
4.4. Only services listed in the itinerary or program are included in the price. Additional services and personal expenses are paid separately by the Client.
4.5. To confirm the Booking, the Client must make a prepayment as specified in the invoice. Payments are processed through secure, certified payment systems.
5. Deposits and Invoicing
5.1. A Booking becomes effective only after the deposit is received and the Company has issued written confirmation.
5.2. The deposit amount varies depending on the tour type, season, and supplier requirements.
5.3. By paying the deposit, the Client confirms acceptance of these Terms and the price stated in the invoice.
6. Changes to Bookings
6.1. Changing the tour date more than 30 days before departure is free of charge.
6.2. Changing the date of an individual tour within 30 days of departure may incur a fee of up to 15% of the tour price.
6.3. If the Client joins the tour late or leaves early, no refunds are provided.
7. Cancellation Conditions (Client)
7.1. Cancellations are accepted only in writing via email to the Company.
7.2. Cancellation terms apply based on the date the Company receives written notice:
- From payment date: 10% of the total Booking cost is non-refundable.
- 90–41 days: 20% retained.
- 40–31 days: 25% retained.
- 30–20 days: 30% retained.
- 19–7 days: 50% retained.
- 7 days or less: 100% retained.
7.3. Special cancellation conditions may apply to specific suppliers, seasonal programs, or special offers.
8. Cancellation by the Company
8.1. The Company may cancel a tour for significant reasons, including unsafe weather, road closures, political instability, force majeure, or insufficient group size.
8.2. In such cases, the Client receives a full refund of the amount paid.
8.3. The Company is not responsible for additional expenses such as flights, visas, or accommodation.
9. Complaints
9.1. The Client must notify the guide or Company representative immediately if any issue arises.
9.2. If unresolved, the Client must submit a written complaint within 30 days after the tour. Complaints submitted after this period will not be considered.
10. Passports, Visas, and Travel Documents
10.1. The Client is responsible for ensuring valid passports, visas, insurance, and other necessary documents.
10.2. The Company is not liable for losses resulting from missing or incorrect documentation.
11. Insurance
11.1. Travel insurance is not included.
11.2. The Client must have insurance covering medical expenses, emergency evacuation, and baggage.
11.3. Without insurance, all expenses are the Client’s responsibility.
12. Health
12.1. Participation requires appropriate physical condition.
12.2. The Client is responsible for assessing personal fitness.
12.3. Clients must ensure they are medically fit to travel.
13. Client Contact Information
13.1. The Client must provide accurate contact information.
13.2. Emergency contact details must also be provided.
14. Release Form
14.1. All Clients must sign a Release Form before departure.
14.2. Adventure travel involves inherent risks acknowledged by the Client.
15. Conduct During Tour
15.1. The Client must comply with local laws and customs.
15.2. Respect for local culture and traditions is mandatory.
15.3. The Company may remove the Client from the tour without refund for dangerous or disruptive behavior.
16. Force Majeure
16.1. The Company is not responsible for delays or changes caused by weather, natural events, political activity, or other force majeure situations.
17. Travel Documents
17.1. Clients receive a tour information package and pre-departure instructions upon Booking and must read them carefully.
18. Liability and Indemnification
18.1. The Client accepts that tours may involve risk, remote areas, and natural hazards.
18.2. The Company is not liable for injury, death, loss, or damage arising during participation.
18.3. The Client indemnifies and holds the Company harmless from claims or damages arising from participation.
19. Privacy Policy
19.1. Personal information is processed in accordance with the Company’s Privacy Policy.
19.2. Data may be transferred to service providers solely for tour operations or payment processing.
20. Use of Website Materials
20.1. Non-commercial use of content is permitted with proper attribution.
20.2. Commercial use requires written permission from the Company.
